PIVOT WELLBEING TERMS AND CONDITIONS OF SALE

Introduction

These Terms of Purchase set out how you (the User) can make purchases from our site Pivot Wellbeing. Please read them carefully. We pride ourselves in providing a high level of customer service and ensuring that you are clear in respect of all of your rights relating to your purchase. Ahead of making any purchase you will be asked to tick a box on our Site or via an electronic form which says “I Accept the Terms and Conditions of Sale”. In ticking that box, you will be accepting the terms set out here.

We are based in the UK and our Terms of Purchase are governed by UK legislation. 

The Terms of Use for our Site and our Privacy Statement can be found on separate pages. 

It is always our aim that you will be fully satisfied with your purchase. Should you have any questions about your purchase we will be happy to assist. 

Purchase Terms for Services

The details of each specific service and the terms of delivery associated with it are described on each page of the website and delivered in accordance with these terms. You should review those terms in detail before purchasing. 

If you purchase as a consumer, rather than a business, then should you change your mind following your purchase you are entitled to a refund within the first 14 days. Should you receive any element of the service prior to requesting a refund then any refund will be issued pro-rata for the services provided. 

We appreciate that in some instances, you may find yourself unable to attend an appointment that you have made. If you are unable to attend your appointment, please provide us with as much notice as possible. Any cancellations made with at least 24 hours' notice before your appointment time can be rescheduled to the next available appointment with no charges. If you are unable to attend your appointment or seek to cancel with less than 24 hours' notice the appointment fee will be charged in full. Similarly, if you are more than 5 minutes late for your appointment, the appointment will be deemed to have taken place. In some instances it may be possible to start the appointment late but depending on the nature of the service you are receiving sometimes it is not possible to begin an appointment late and in those instances the appointment will be deemed to have taken place and no refund or alternative session will be provided. 

Please be aware that if you make a booking with less than 24 hours between your booking and your appointment date and then you decide to cancel, we will not be able to offer you a refund as our cancellation policy is that we must have at least 24 hours' notice. Please ensure that you check your diary and availability prior to making any bookings and that you contact us as soon as possible if you are unable to attend. 

Memberships are purchased on a monthly reoccurring basis until cancelled. If a membership is cancelled, then the benefits and services will continue to be provided until the next payment date. All memberships will provide a minimum of 8 live classes per month.

Purchase Terms for Non-Customised Products

We are proud of our Wellbeing Programs and the results which our clients achieve from them. If you buy any of the Wellbeing Programs you are purchasing access to the program via www.pivotwellbeing.com for a minimum of 6 months. Once you have purchased the program and and your payment has been processed. You are invited to create a membership log in and you will receive an email once access is granted. You can then view the program as often as you wish within the 6 month period. As you receive access to the full program you will not be entitled to receive a refund so do check that you are purchasing the correct product or service to meet your needs. Your other statutory rights to a refund remain in place in the usual way.

Please be advised that we reserve all rights to our intellectual property for our products and services. This means that whilst you are free to use the download digitally or print out a copy for personal use you are not permitted to copy, distribute, adapt, edit or share any of our products with third parties.

Pricing

The prices are as quoted on the website for each item. Prices do include VAT.

We may change our prices at any time but changes will not affect any order in respect of which we have already sent you an order confirmation.

It is always possible, despite our best efforts, that some products listed on our Site may be incorrectly priced. If a product's correct price is higher than the price stated on our Site, we will contact you to inform you of the error and give you the option of either continuing your purchase of the product at the correct price or cancelling your order. If we are unable to contact you using the details you provided during the order process, we will treat your order as having been cancelled and notify you in writing. We are under no obligation to provide any product to you at an incorrect (lower) price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

Additional Circumstances

Should you consider that you have grounds to obtain a refund which are not set out above you should email jennifer@pivotwellbeing.com to set out your refund request. 

All refunds are provided in accordance with your statutory rights. 

Law and Jurisdiction

These terms and any claim or dispute arising in relation to any purchase will be governed by English law. You and we agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such claim or dispute.
